The Ecuadorian Intellectual Property Office (SENADI) will continue to provide service to users during the State of Emergency

The Ecuadorian Intellectual Property Office-SENADI- has taken measures to keep an uninterrupted attention to its users within the Sanitary Emergency decreed by the Ecuadorian government within COVID-19.

On March 12, 2020, the Ecuadorian Ministry of Heath decreed a State of Sanitary Emergency in the country as a preventive measure within the emerge of COVID-19. Consequently, the Ecuadorian government issued guidelines for the application of home office, for public and private institutions.

Given the current situation of the country and the measures taken by the government, the National Intellectual Property Office-SENADI- issued measures to keep an uninterrupted attention to its users. On March 15, SENADI ordered the suspension of the usual calculation of deadlines within national procedures, until March 31, 2020, and it has been extended until April 5, 2020.

Despite the suspension of deadlines, SENADI has submitted an official pronouncement that as for long as the emergency measure is maintained, its online services will be enabled, to avoid the accumulation of procedures. However, this intention has been frustrated due to the fact that there are some procedures that cannot be performed online, since this institution was not used to apply automated mechanisms for initiating and receiving online procedures. Therefore, currently, the administrative staff is manually validating these procedures- via email-which has caused delay.

SENADI has developed the following service mechanism; the requirements are met as they arrive at the inbox of the official in charge. The validation of bank transfers takes approximately 4-5 days, since its manual verification is carried out by a single Official, the aforementioned, to allow the users to start the online process. Also, there may be a delay within the verification of the status of procedures, since Officials are working from their homes, and for security reasons, they cannot have access to all of the institution´s data bases.

SENADI reaffirms that, since the calculation of deadlines of all national procedures has been suspended, there are no urgent national phase cases until such measure is lifted. Also, the Official Gazette of Intellectual Property would not be published until further notification.
